When parents separate, it is always important to consider the arrangements for the upbringing of children.  Court proceedings should only be commenced if all other reasonable avenues, such as mediation and negotiation, have been exhausted.  We aim to help you to reach an agreement in a constructive and non-confrontational way.

Your child’s welfare is the paramount consideration and factors taken into account will include

  • The wishes and feelings of your child bearing in mind his/her age and understanding;
  • His or her physical, emotional and educational needs;
  • The likely effect any change in circumstances.
  • Your child’s age, sex, background and any other relevant characteristics;
  • Any harm that yuor child has suffered or is at risk of suffering;
  • The ability of both parents to meet your child’s needs, now and in the future.

If agreement cannot be reached between the parents it may be necessary to apply to the Court for assistance.  The Court may then order that you and your child abide by rules that the Court will set for you.
